Legal Action Contemplated in San Francisco
This is the brief that Executive Director Mark Block filed with the San Francisco Board of Supervisors today at their 2:00 pm hearing on the anti-vaping ordinance. It is a preliminary outline of the causes of action that store owners, users and manufacturers can file to challenge the Supervisors’ decision to pass the ordinance. All elements of the causes will be developed as plaintiffs step forward to sue. The Supervisors voted unanimously to pass the ordinance to ban flavors and in effect destroy the industry that provides the most effective, safe alternative to cigarette smoking—-the city known for personal freedom voting to block personal freedom to vape for health and life.
