Days could be numbered for the notorious FDA deeming regulations as efforts to repeal and replace gain new momentum. This week the U.S. Congress is back in session and if all goes according to plan, Rep. Duncan Hunter will introduce comprehensive legislation which would take vapor products out of the tobacco products category and completely shutdown the industry killing PMTA process.

A CALL FOR SUPPORT FROM OUR INDUSTRY’S LEADERS
Hello Fellow Industry Members,
I hope this finds you well. We’re writing you on behalf of several businesses within our industry (listed below) who are united in their support of the EVCA (Electronic Vaping Coalition of America) and their fight against the FDA Deeming Regs. We at Wisco Liquids are working with EVCA to help crowd fund their efforts to “Repeal & Replace” the FDA Deeming Regs through a legal process referred to as “Coordination,” which we believe is one of the best strategies currently available to our industry. For those of you who are not up to date with recent developments by EVCA, please read the notes at the bottom of this email, which are also laid out on the crowd funding page at Generosity.com.
Just know that this strategy is one of legal recourse, and not a political one. The clock on current regulations could be stopped in 60-90 days!
This is NOT another petition. EVCA is already putting their words into action and is unlike other organizations out there. 100% of funds will go directly towards the legal process of “Coordination” by which we can stay, withdraw, or shelve the offending regulations.
“One drop does not fill a bucket, but 1000 drops do.” Any size donation, no matter how small, will help our efforts.
Here is what we’re asking of you:
1. WE URGE YOU TO DONATE! If you have not already donated to this new effort, we encourage you to do so. Donations will be accepted through our campaign “Support the EVCA” on Generosity.com which is a great tool to reach the masses of vapers and businesses around the country. Any amount is helpful, but please try to be generous. Time is of the essence.
2. HELP US MAKE THIS GO VIRAL! Share this with your customers, local vaping groups, social media groups and pages, and with fellow businesses. Post and repost on Facebook, Instagram, Twitter and in forums. Send an email out to your subscribers. Don’t forget to include your friends and family! We all have people in our lives that may not be vapers, but who care about the positive impact our industry has and would gladly give a few bucks to the cause. After being a smoker for 29 years, my family knows the impact vaping had on me and will be helping out.

3. RUN YOUR OWN INCENTIVES AT YOUR BRICK & MORTAR OR ONLINE BUSINESS!
With proof of donation, you could offer a discount or promotional item to your customers. We’ve already spoken to many businesses that plan to give discounts with proof of donation, either in advance of customers coming in, or on the spot! For example, if a customer donates $25 or more, you could offer them a bottle of juice at 50% off, or an overall discount on their transaction. Another idea is an in store raffle for customers who have donated. Create your own promotion, and help spread the word on your social media pages!
4. BE A PART OF THE INCENTIVES LISTED ON THE GENEROSITY.COM PAGE
We currently are offering discounts that are valid on a few websites for fellow business owners who have donated to the EVCA. Details on the “Coordination” process:
The Electronic Vaping Coalition of America (EVCA) is implementing a very unique strategy in their efforts to “Repeal & Replace” the FDA Deeming Regulations. They are implementing the legal process of “Coordination,” which has been used on many occasions to push back against over-regulation.
To put it simply: Federal law requires that all levels of government “Coordinate” with the lowest level of government (the one closest to the people) prior to enacting any policies, laws, or regulations in order to ensure that there is no negative economic impact on the local community.
We all know that the FDA Deeming Regulations not only have a negative impact on our businesses, but as our businesses suffer, so do the communities in which we reside. Through the legal process of “Coordination” the case will be proven that the FDA failed to follow the law prior to implementing the regulations, and the process will prove that the deeming regulations will have a negative economic impact on local communities.
EVCA is working with the Village of Hartland, WI to call the FDA into the process of “Coordination,” and through legal testimony in official hearings will prove, without a doubt, that the deeming regulations need to be “stayed” or in effect, stopped. The process has five phases, and we are working to complete funding by April 30. Total funds needed = $225,000 (EVCA has already raised about $25,000, so the goal for the crowd funding page is the balance).
We believe this strategy will be effective in our fight against the regulations. Please join with us to fund this very important effort to save the vaping industry.
